THE FOLLOWING ARE MOTIONS MADE DURING THE REGULAR MEETING OF THE INLAND WETLANDS AGENCY/ CONSERVATION COMMISSION – MADDEN ROOM

Vice Chairperson Kelly called the meeting to order at 7:00 pm

ITEM:  CORRESPONDENCE AND REPORTS

Commissioners had each received a copy of the most recent Habitat in their meeting packets.

ITEM:  MINUTES: 3/17/2010

Motion to: approve the minutes from 3/17/2010

ITEM:  CONSERVATION COMMISSION

Folger reported that for the last 2 weekends a scout troop and a church group spread wood chips on the trails at Wapping Park – improved condition of the trails, especially muddy sections in wooded areas.  These 2 groups will be recognized with certificates.  An eagle scout built an observation platform on edge of pond off Slater Street.  There are 2 proposed scout projects for the next couple of months:  one to rehab a gravel parking lot on West Road by clearing brush and building a rail fence around it; the other is to create a trail from this parking lot to the main trail in Major Michael Donnelly Land Preserve.

ITEM:  WETLAND OFFICER’S REPORT

Folger advised the Commissioners that there is an issue with a landowner he has been working with in regard to a neighbor’s complaint involving wetlands.  If the situation is not rectified within the specified timeframe of June 1, 2010, a cease and desist order will be issued.   A “Show Cause Hearing” will then be held at the next IWA/CC meeting on June 16, 2010.

Commissioner Brower expressed concern for increased dump truck/construction equipment activity off Sullivan Avenue near the animal hospital in relation to proposed soccer fields to be built in town by a private organization.  Folger said he would check into this issue.  Folger stated that 2 soccer fields were approved on West Road, that no wetland permits are required at this time as only turf grass will be planted and that the activity associated with the proposed use will not have any more impact than when used as a corn field.  

Commissioner Blondin requested an update on the CT Studios project.  Folger stated that he believed they are on track for summer ground breaking – July or August, that the footprint has been reduced – less impervious surface, buildings closer together, possibly an above ground detention basin instead of infiltrators.  Commissioner Delnicki’s asked if they would have to come back to IWA/CC.  Folger stated that would not be required at this time if this is handled as a “Change Order” because they are reducing the impact and there is no change to any of the locations/impacts to the upland review area.
Commissioner Blondin asked about the relocation of the tiger beetles.  Folger said beetles have been and are being moved successfully to the Barton property.  Though a remnant population of beetles remains on the original site, as far as DEP is concerned the Town has fulfilled its obligation/task.  

ITEM:  NEW BUSINESS:

Appl #10-27P – Guarino Subdivision. – Abbe Road – Conservation Commission application to approve a four lot residential subdivision., and associated improvements on property located westerly of Abbe Road, and southerly of Griffin Road, A-20 Residential Zone.

Tim Coon, Engineer-JR Russo, presented the application.  Of the 7 lots total proposed for the subdivision, 4 lots are located in SW – these lots will have town sewer and water (CT Water), roof run-off will be handled by individual infiltrators.  Mr. Coon stated that based on comments from the Town Engineer, a small detention basin may be placed on Abbe Road to tie into the catch basin on Griffin to control sheet runoff.  The common driveway leading to the interior lot will deflect runoff that is currently flowing to property located on Griffin Road. There are no wetlands or watercources on property.  Folger stipulated that the trees in the wooded area remain until all sites are stable. The builder, Paul Guarino, agreed to Folger’s request.  Folger stated that erosion and sediment controls are adequate with the hay bales and silt fence.  Folger told Mr. Coon that soil information is to be included with each application for a building permit and will  be reviewed by the Town Engineer to ensure the infiltrators will operate as planned.

Motion to: approve Appl #10-27P – Guarino Subdivision. – Abbe Road – Conservation Commission application to approve a four lot residential subdivision., and associated improvements on property located westerly of Abbe Road, and southerly of Griffin Road.  A-20 Residential  Zone, with following conditions:

1.      The final approved copy of the entire set of plans and this letter reproduced thereon must be submitted to the Planning Department.  This must be completed within 65 days of approval prior to any construction activity on the site.  Plans submitted to Planning & Zoning Commission shall be considered having met this requirement.
2.      The application shall indemnify and hold harmless the Town of South Windsor against any liability, which might result from the proposed operation or use.
3.      The permit is valid for five years and shall expire on June 2, 2015. It is the landowner(s)
/applicant(s) responsibility to track expiration dates and notify the Commission of a renewal request at least 65 days prior to expiration.
4.      All approvals required must be obtained and submitted prior to any activity on the site.
5.      A contact person shall be identified on the plans.

Appl. #10-28P – Town of South Windsor – Nevers Road – Conservation Commission application to construct an addition to the Senior Center and Associated improvements on property located easterly of Nevers Road, RR, Rural Residential Zone - Postponed to 6/16/2010 – signs not posted on site as required.

Appl. #10-29P – McDonalds Restaurant – 1049 John Fitch Blvd. – Inland Wetlands/Conservation Commission application to construct McDonalds restaurant and associated improvements on property located westerly of John Fitch Blvd and northerly of Governors Highway.  RC, Restricted Commercial Zone.

Dorian Famiglietti, Attorney with Kahan, Kerensky & Caposella, represented the applicant.  Ms. Famiglietti stated that approximately 800 sq ft of upland review area would be involved in construction of a proposed deceleration lane off Route 5.  In addition, Ms. Famiglietti stated that the applicant is also seeking approval of the conservation plan.

 John Kucich, Bohler Engineering, stated that the building is being proposed as far from the regulated area as possible.  A small deceleration lane is being proposed to enter into the site to slow speeds down from the road.  Sandy soil and very flat area - not high risk for erosion issues.  Stormwater runoff will be handled by an underground infiltration system on site.  Rate and volume of runoff from site will be substantially reduced.  Hooded catch basins will captured sediments prior to reaching the underground infiltration system.

Commissioner Brower asked if soil preparation had been done?  Yes, in 2007 soil was blended, contaminants were deemed low at that time.  This project does not propose to affect the undeveloped area of the property at this time.  Folger stated the landowner was cooperative with recommendations for cleanup of the agricultural field at the time of purchase.

Folger stated that the biggest chore probably would be maintaining the entrance pad during construction to keep material from getting into the street.  There will be temporary sediment basins on site during construction.
John Ianni, Soil Scientist-Highland Soils, reviewed his report dated May 3, 2010 regarding wetlands delineation and stipulated that it is accurately represented on the plan.

Commissioner Phillips asked if the proposed building is to replace the current McDonald’s located on Route 5?  Yes, it is a relocation of the store from one location to another.

Motion to: approve Appl. #10-29P – McDonalds Restaurant – 1049 John Fitch Blvd. – Inland Wetlands/Conservation Commission application to construct McDonalds restaurant and associated improvements on property located westerly of John Fitch Blvd and northerly of Governors Highway.  RC, Restricted Commercial Zone, with the following conditions:
1.      The final approved copy of the entire set of plans and this letter reproduced thereon must be submitted to the Planning Department.  This must be completed within 65 days of approval prior to any construction activity on the site.  Plans submitted to Planning & Zoning Commission shall be considered having met this requirement.
2.      The application shall indemnify and hold harmless the Town of South Windsor against any liability, which might result from the proposed operation or use.
3.      The permit is valid for five years and shall expire on June 2, 2015. It is the landowner(s)
/applicant(s) responsibility to track expiration dates and notify the Commission of a renewal request at least 65 days prior to expiration.
4.      A bond shall be collected in the amount of $5,000 to ensure proper placement and maintenance of erosion and sediment controls, and $10,000 for installation of storm water systems.
5.      All approvals required must be obtained and submitted prior to any activity on the site.
6.      A contact person shall be identified on the plans.

Motion to:  hold a public hearing on Appl #10-30W Town of South Windsor – Main Street Bridge Reconstruction Project – IWA/Conservation Commission application for the reconstruction of the bridge at Main Street including associated improvements to the drainage and stormwater structures.  The site is located southerly of Strong Road and northerly of Governor’s Highway on June 16, 2010.  The reason being the potential impact on wetlands and watercourses, and public interest due to tax payer funding of project.
